My clients often ask me if they are able to get the engagement ring back after the divorce is finalized. Unfortunately, the question is no – the person that was given the ring gets to keep it. An engagement ring is not subject to equitable distribution. The ring was given with promise that the parties would get married. After the marriage takes place, the promise has been satisfied and it should not be returned. Therefore, the engagement ring should only be returned if the engagement is broken and the parties do not get married.
