As a part of her bail conditions, a New Jersey woman is barred from posting on Facebook about her family. I believe that this case will carry some weight in divorce and other family law cases in the future. There are cases where a spouse publicly bashes the other spouse or inappropriately writes about the children. Using this case as guidance, I believe a family law judge could impose the same prohibition from posting on Facebook or other social media. This appellate decision states that the limitation on speech is aimed at protecting the children, therefore, it does not violate the First Amendment.
